Agely provides age verification tools designed to help community owners — Discord server owners today, website and app operators later — manage their communities. Our service is intended to:

• Provide Extra Confidence: give community owners additional assurance that members meet age requirements
• Support Community Management: help communities enforce their own age policies
• Enhance Trust: create a layer of verification beyond self-reported age

Our service is NOT intended to:

• Serve as legal proof of age for regulatory compliance
• Replace legal identity verification processes
• Guarantee 100% accurate age determination
• Provide enforceable legal documentation of age

2. Accuracy Limitations and Variables

Age estimation can be incorrect.

Facial age estimation algorithms analyze physical appearance, which varies significantly between individuals and can be affected by numerous factors. Results should be treated as estimates, not definitive proof.

2.1 Age Estimation Accuracy Factors

Age estimation accuracy can be affected by:

• Image Quality: poor lighting, low resolution, or camera angle can reduce accuracy
• Individual Variation: some people naturally look younger or older than their actual age
• Ethnicity and Genetics: algorithms may perform differently across demographic groups
• Physical Appearance: makeup, facial hair, accessories, or expressions can affect results
• Health and Lifestyle: various factors can influence perceived age

2.2 Security Considerations by Verification Method

Most Secure: Combined Method (Recommended)

ID Validation + Face Match + Age Estimation

Using these methods together provides the highest confidence — reading the identity-document data, matching your selfie to the ID photo, and cross-checking the AI-estimated age. Important: Agely reads the text on an ID; it does not verify that the document itself is genuine or unaltered.

Individual Methods: Lower Security

Using verification methods individually creates opportunities for users to circumvent or "spoof" verification:

• Age Estimation Alone: someone could present a photo or video of another person, manipulate lighting, or use age-altering filters. Enabling the optional liveness (anti-spoof) check on the selfie reduces this risk
• ID Validation Alone (without face match): the document's text is read but the document is not authenticated, so a genuine-looking but fraudulent or borrowed ID can pass
• Why combine methods: because Agely reads an ID's text rather than proving the document is real, ID checks are strongest when paired with the selfie face-match and age estimation

Community owners should understand these tradeoffs when configuring verification requirements for their communities.

3. Responsibility Distribution

3.1 Platform Responsibility

The platform a community runs on keeps its own obligations. When Agely is used through Discord, Discord, Inc. is ultimately responsible for:

• Ensuring all Discord users meet the minimum age requirement (13+ in most jurisdictions)
• Managing access to age-restricted channels and content on their platform
• Enforcing Discord's Terms of Service and Community Guidelines
• Compliance with COPPA (Children's Online Privacy Protection Act) and similar regulations

3.2 Community Owner Responsibility

Community owners are responsible for:

• Understanding the accuracy limitations of automated age verification
• Configuring appropriate verification requirements for their community's needs
• Making final decisions about member access to their communities
• Complying with applicable laws regarding age-restricted content in their jurisdiction
• Implementing additional safeguards if required for their specific use case
• Not relying solely on Agely for legal age verification where laws require formal processes

3.3 Agely's Role

Agely provides:

• Age verification tools to support community management
• Reasonable efforts to provide accurate verification results
• Transparency about service limitations and accuracy factors
• Privacy-focused data handling with automatic deletion

Agely does NOT provide:

• Legal age verification for regulatory compliance
• Guarantees regarding verification accuracy
• Liability protection for community owners using our service
• Legal advice or compliance guidance

4. No Professional Advice

The information provided through our Service does not constitute:

• Legal advice or legal opinions
• Compliance guidance or regulatory consulting
• Professional identity verification services
• Recommendations regarding legal obligations

5. Third-Party Services and Content

Our Service integrates with third-party services including:

• Discord: we are not affiliated with, endorsed by, or sponsored by Discord, Inc.
• Clerk: authentication services (see their privacy policy)
• Vercel: hosting, cookieless website analytics, and the short-lived private storage that briefly holds verification media before deletion
• Neon: database (verification status and settings only)
• Amazon Web Services: biometric AI processing (age estimation, ID text extraction, face matching, liveness) — images are analyzed transiently and, because we have opted out of AWS's AI-service data retention, are not retained by AWS

We are not responsible for the content, privacy practices, or availability of third-party services.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Agely shall not be liable for inaccurate verification results
• Agely shall not be liable for decisions made based on verification results
• Agely shall not be liable for any indirect, incidental, or consequential damages
• Agely's total liability shall not exceed the amount paid for the Service (if any)

This includes but is not limited to liability for:

• False positives or false negatives in age verification
• Access granted or denied based on verification results
• Compliance failures or regulatory violations
• Fraudulent circumvention of verification processes
• Data breaches affecting third-party service providers
• Service interruptions or unavailability

7. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

We specifically disclaim any warranties regarding:

• Accuracy: no guarantee that verification results are correct
• Reliability: no guarantee of service uptime or availability
• Security: no guarantee against circumvention or fraud
• Compliance: no guarantee that using our Service satisfies legal requirements
• Fitness: no guarantee the Service is suitable for your specific purpose
